Dear guests, customers and friends of Hennich & Hanschel city tours TrierT
he following General Terms and Conditions (GTC) regulate the contractual relationship between you as the client (guest) and “Hennich & Hanschel GbR” (hereinafter referred to as the tour guide). You accept these following contractual conditions with your booking.
1. Basis and terms
1.1. The contractual partners for a guided tour/tour are the customer/orderer/client (hereinafter referred to as ‚guest‘) on the one hand and “Hennich & Hanschel GbR” on the other. All contractual relationships between these two contracting parties are governed exclusively in accordance with the following provisions.
1.2. Below, the term “guest” refers to individual guests as well as clubs, institutions, companies and commercial clients of tours.
2. Conclusion of contract
2.1. Every booking is made subject to the general terms and conditions of “Hennich & Hanschel GbR” valid at the time of booking.
2.2. The booking can be made verbally, by telephone or by email. All agreements, side agreements and special requests are only effective if they have been agreed with the tour guide in writing or by telephone (if possible at least 24 hours in advance).
2.3. If the confirmation is incorrect with regard to the agreed content of the contract, the guest must object in writing within 7 days at the latest. If there are less than 7 days between the conclusion of the contract and the agreed date for the provision of the service, the objection must be made immediately.
2.4. The contract becomes valid through postal or electronic confirmation from “Hennich & Hanschel GbR”.
3. Benefits
3.1. The service owed by “Hennich & Hanschel GbR” consists of carrying out the tour of the guests in accordance with the service description and the additional agreements made.
3.2. Changes to essential services that deviate from the agreed content of the contract, which become necessary after conclusion of the contract (changes in the timing of the tour, road closures, construction work, changes to opening/closing times) and which were not brought about by the tour guide against good faith, are permitted , as long as the changes are not significant and do not affect the overall layout of the tour. Any warranty claims of the guest in the event of such changes to essential services remain unaffected.
3.3. Unless otherwise described or agreed, the maximum size for groups on (partial or full) walking tours is 30 people.
3.4. Information on the duration of tours is approximate.
3.5. For groups of students, the class size including supervisors applies. Please note that if the class is divided, at least one supervisor must remain with each group. The tour guides assume no duty of supervision here.
3.6. The tour generally takes place whatever the weather.
4. Prices and Payment
4.1. The agreed prices include the implementation of the tour and additional advertised or agreed services.
4.2. The period for calculating the fee begins at the latest at the agreed time of the start of the tour.
4.3. The guide fee must be paid in cash to the tour guide against a receipt. Payment by invoice is only possible at the express request of the customer and must be reported in writing no later than seven days before the agreed date. In this case, the invoice will be issued up to three working days after the order has been fulfilled.
4.4. Payment with vouchers is possible if they are correctly filled out and signed by the tour guide and handed over to the tour guide. “Hennich & Hanschel GbR” will then issue an invoice to the tour operator.
4.5. Any additional costs that may arise (e.g. for entrance fees, meals, transport, etc.) that are not part of the contract must be paid by the guest in cash directly on site.
4.6. If the planned duration of the tour is extended at the guest’s request and the tour guide agrees to continue leading the group, an additional fee of 1 hour is due for an extension of up to 60 minutes (€70).
5. Non-use of services
5.1. If the guest does not make full or partial use of the agreed services without the tour guide being responsible, in particular by not arriving or not starting the tour without terminating the contract, even though the tour guide is willing and able to provide the service, this is the case the guest is obliged to pay in full for the agreed service. There is no entitlement to a refund for services already paid. There is no entitlement to reschedule the tour.
5.2. The statutory regulation applies to the agreed remuneration (§ 615 sentences 1 and 2 BGB).
6. Withdrawal, cancellations and changes
6.1. “Hennich & Hanschel GbR” should be notified of withdrawals or (partial) cancellations during normal business/duty hours, preferably in writing, Monday – Friday from 9 a.m. to 4 p.m.
6.2. If the guest cancels at short notice, the tour guide is entitled to a cancellation fee. If “Hennich & Hanschel GbR” has incurred costs for renting or canceling third-party services, these will be charged to the guest additionally.
6.3. Cancellations are possible free of charge up to seven days before the booked date.
6.4. If you cancel from seven days to 24 hours before the booked appointment, 50% of the agreed price will be charged.
6.5. In the event of termination later than 24 hours before the start of the tour and on the day of the tour itself, the full agreed remuneration is due for payment.
6.6. Our tour guides are instructed to wait 30 minutes at the agreed meeting point. The duration of the tour is shortened accordingly. If the waiting time is exceeded, this will be considered a no-show and will be billed at 100% of the agreed price.
7. Liability of the tour guide
7.1. The tour guide is not liable to the guest and their companions; claims for damages are excluded. Excluded from this is liability for culpably caused damage resulting from injury to life, body and health that is based on at least a negligent breach of duty by the tour guide, as well as for other damage that is caused by at least a grossly negligent breach of duty.
7.2. The tour guide is not liable for services, measures or omissions of catering establishments, establishments, operators of sights or other offers that are visited as part of the tour, unless the tour guide’s culpable breach of duty was the cause or contributory cause of the damage.
8. Ineffective provisions and place of jurisdiction
8.1. Severability clause: If a provision of these General Terms and Conditions is invalid, the remaining provisions remain unaffected.
8.2. The place of performance is the place where the service is provided. The place of jurisdiction is Trier.
